Odaily Planet Daily News informs: The Yinchuan City Xingqing District People’s Court recently concluded a civil and commercial dispute arising from a delegated investment in virtual currency. The plaintiff, Wei (full name withheld), got acquainted with the defendants, Li and Hu, through the internet. He then transferred funds to Li,委托他与Hu共同进行虚拟货币投资操作. In the initial stage, the investment generated some returns, and the plaintiff participated in the distributions. Later, because the plaintiff urgently needed funds and requested the return of the investment amount, but this was not successful, he sued in court using the claim of “unjust enrichment.”

After reviewing the case, the presiding judge believed that the underlying legal relationship in this case should be a delegation contract relationship. The judge explained to the plaintiff that suing on the grounds of unjust enrichment entails a relatively high risk of losing the case. At the same time, the judge pointed out to the defendant side that there indeed was a delegated investment relationship between both parties, and if the case proceeded as a delegated contract dispute, the defendant would very likely bear the obligation to return the funds. After mediation, the plaintiff withdrew the lawsuit against Hu. Li returned the plaintiff’s investment principal, and both parties reached a settlement agreement.
