According to Beating, Elon Musk traveled to China this week with U.S. President Trump without obtaining federal judge approval to leave the jurisdiction of the OpenAI litigation, two sources said. Musk remains on standby for potential court summons. Last month, Musk testified in court for three days in California, alleging that OpenAI’s establishment of a for-profit division violated its founding mission. When he left the witness stand on April 30, the judge, at OpenAI’s lawyers’ request, explicitly instructed Musk to be ready for recall at any time. The case’s final evidence submission hearing is scheduled for this Wednesday, with closing arguments on Thursday; if called back, Musk would face extreme time pressure to return to court.
