Boston Federal Judge Stays Execution of $100,000 H-1B Visa Fee Ruling on June 12

On June 12, Federal judge Leo Sorokin in Boston stayed execution of his earlier order regarding the $100,000 fee imposed on new H-1B visa applicants, following an emergency appeal by the Trump administration. On June 8, Sorokin had ruled the fee violated Congress's exclusive taxing authority and the separation of powers doctrine. The Trump administration filed a motion on June 12 requesting the stay pending the First Circuit Court of Appeals' decision on the merits.
